H-2B Visa Extensions
Already working in the USA on an H-2B visa? Learn how to extend your stay with the same employer, or find a new H-2B employer for the next season.
Understanding H-2B Extensions
The H-2B visa is issued for the duration of the employer's approved temporary need, typically up to one year. Under certain circumstances, the employer can file for an extension, allowing workers to continue their employment beyond the original end date.
Extensions must be filed by the employer before the current authorisation period expires. The extension is employer-specific, workers cannot simply transfer to a new employer without a new petition being filed on their behalf.
Workers may be extended up to a total maximum stay of 3 years, after which they must spend 3 consecutive months outside the United States before being eligible to apply again.
Eligibility for Extension
Do Not Overstay
Overstaying your authorised period of stay is a serious immigration violation. Always depart before your I-94 expiry date. Overstays can result in multi-year bars on future US entry.
